Terms & Conditions

1. Acceptance of Terms

By accessing or using MyHealthX (myhealthx.co.in), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our Platform. These terms constitute a legally binding agreement between you and MyHealthX, enforceable under Indian law including the Information Technology Act, 2000 (Section 10A — validity of electronic contracts) and the Indian Contract Act, 1872.

2. Description of Service

MyHealthX is a technology platform that provides:

Emergency Medical QR ID creation and management
Emergency scan pages displaying critical medical information
WhatsApp-based emergency contact alerts
Connection with verified doctors and hospitals (upcoming)
Time-limited, OTP-verified medical records sharing

MyHealthX is a technology platform, NOT a healthcare provider. We do not provide medical advice, diagnosis, or treatment. We function as an "intermediary" as defined under Section 2(w) of the Information Technology Act, 2000.

3. User Registration and Account

You must provide accurate and complete information during registration.
You are responsible for maintaining the accuracy of your medical information.
You must be at least 18 years old to create an account. For users under 18, a parent or legal guardian must register on their behalf with verifiable parental consent as required by Section 9 of the DPDPA 2023.
You are responsible for maintaining the security of your account credentials.
One account per phone number is allowed.
Any impersonation or use of another person's identity is punishable under Section 66C of the IT Act 2000 (identity theft — up to 3 years imprisonment and ₹1 lakh fine).

4. Consent

Before registration, you will be asked to provide explicit consent for the following, each through a separate checkbox:

(a) Data collection and storage of your personal and medical information
(b) Display of emergency medical information to anyone who scans your QR code
(c) Authorization for WhatsApp alerts to your emergency contacts
(d) Agreement to these Terms and our Privacy Policy

These consents are recorded with timestamps and can be withdrawn at any time by deleting your account, as per Section 6 of the DPDPA 2023.

5. QR Emergency Medical ID

Your Emergency QR code is generated after successful payment of the subscription fee.
The QR code is generated once and the URL never changes, even if you update your medical information. This ensures physical QR cards remain valid permanently.
By activating your QR code, you consent to your emergency medical information being visible to anyone who scans it.
You can deactivate your QR by deleting your account.
MyHealthX is not responsible for how third parties use information obtained by scanning your QR code, provided we have maintained reasonable security practices under Section 43A of the IT Act 2000.

6. Emergency Information Display and Alerts

When your QR is scanned, basic emergency medical information is displayed. By using this service, you understand and agree that:

This information is shared for emergency medical purposes only.
Alerts to emergency contacts and hospitals are triggered only when someone manually presses the alert button — not automatically upon scanning.
MyHealthX does not guarantee that emergency contacts will be reachable or will respond.
MyHealthX is not responsible for actions taken or not taken by emergency responders based on the displayed information.
All alert actions are logged for security and audit purposes.

7. Scanner Terms (For persons scanning a QR code)

By viewing an emergency medical QR scan page, you agree that:

You will use the displayed information solely for emergency medical assistance.
Any unauthorized access, use, copying, photographing, or distribution of the displayed medical information is strictly prohibited.
Misuse of this information is punishable under:

— Section 43 of IT Act 2000: Unauthorized access to computer resource — liable to pay damages up to ₹5 crore.
— Section 66 of IT Act 2000: Dishonest/fraudulent computer-related offence — up to 3 years imprisonment and ₹5 lakh fine.
— Section 66C of IT Act 2000: Identity theft — up to 3 years imprisonment and ₹1 lakh fine.
— Section 66E of IT Act 2000: Violation of privacy — up to 3 years imprisonment and ₹2 lakh fine.
— Section 72A of IT Act 2000: Disclosure of information in breach of lawful contract — penalty up to ₹25 lakh.
— DPDPA 2023: Violation of data protection obligations — penalties as specified in the Schedule.

8. Accuracy of Information

You are solely responsible for the accuracy of the medical information you provide.
MyHealthX does not verify or guarantee the correctness of any medical data entered by users.
Medical professionals should always conduct their own independent assessment and not rely solely on information displayed through MyHealthX.
MyHealthX is not liable for any medical decisions made based on information displayed on the Platform.
Under Section 15(b) of the DPDPA 2023, you have a duty not to suppress any material information while providing your personal data.

9. Doctor and Hospital Access

Verified doctors and hospitals may request access to your full medical records.
Access requires OTP verification from your emergency contact.
Access is limited to 15 minutes and can be revoked at any time.
All access events are logged for security and audit purposes.
Any breach of confidentiality by a doctor or hospital is punishable under Section 72 of the IT Act 2000 (penalty up to ₹5 lakh) and relevant provisions of the Indian Medical Council Act.

10. Subscription and Payments

The Emergency Health ID is available in two tiers: PVC QR Card and NFC QR Card. Pricing details will be updated soon. All prices are exclusive of applicable GST.
Payments are processed through secure third-party payment gateways (Razorpay/Cashfree).
MyHealthX does not store any payment card or UPI details.
Refunds are available within 7 days of payment if the QR has not been physically printed or shared.
If your subscription expires, your QR code will be deactivated after 90 days. Data is retained for 1 year for reactivation.

11. Prohibited Activities

You agree NOT to:

Register using false identity or another person's phone number (punishable under Section 66C/66D of IT Act 2000)
Provide false or misleading medical information
Attempt to access another user's data without authorization (punishable under Section 43/66 of IT Act 2000)
Use the platform for any purpose other than emergency healthcare
Tamper with or reverse-engineer any part of the platform (punishable under Section 65 of IT Act 2000 — up to 3 years imprisonment)
Introduce any virus or malicious code (punishable under Section 43(c) of IT Act 2000)
File false grievances or complaints (punishable under Section 15(d) of DPDPA 2023 — up to ₹10,000 penalty)

12. Intermediary Status and Liability

MyHealthX operates as an intermediary under Section 79 of the IT Act 2000. As such:

We are not liable for any third-party information stored or transmitted through our Platform, provided we observe due diligence.
We will remove or disable access to any unlawful content upon receiving actual knowledge or a court/government order.
We follow the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
Our liability exemption does not apply if we have conspired, abetted, aided, or induced any unlawful act.

13. Limitation of Liability

To the maximum extent permitted by applicable Indian law:

MyHealthX is not liable for any direct, indirect, incidental, or consequential damages arising from the use of the Platform.
MyHealthX is not liable for any medical decisions, treatments, or outcomes based on information displayed through the Platform.
MyHealthX's total liability shall not exceed the amount paid by you for the subscription in the preceding 12 months.
MyHealthX provides reasonable security safeguards as required under Section 43A of the IT Act 2000. In case of breach due to our negligence, compensation may be claimed under Section 43A.
Section 84 of the IT Act 2000 provides protection for actions taken in good faith.

14. Intellectual Property

The MyHealthX name, logo, design, and all content on the Platform are the intellectual property of MyHealthX.
You may not copy, reproduce, or distribute any part of the Platform without written permission.
Tampering with computer source code is punishable under Section 65 of the IT Act 2000.
User-generated content (medical data) remains the property of the user.

15. Account Termination

You may delete your account at any time, which permanently removes all your data and deactivates your QR code within 72 hours.
We reserve the right to suspend or terminate accounts that violate these terms.
Upon termination, your QR code will display a "Profile Not Found" page.
Data may be preserved if required for ongoing legal proceedings or government investigation under Section 67C of the IT Act 2000.

16. Grievance Redressal

If unsatisfied, you may escalate to:
Data Protection Board of India (dataprotection.gov.in) — for DPDPA 2023 matters
Adjudicating Officer under Section 46 of IT Act 2000 — for compensation claims up to ₹5 crore
Appellate Tribunal under Section 57 of IT Act 2000 — for appeals

17. Governing Law and Jurisdiction

These Terms are governed by the laws of India, including the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and the Indian Contract Act, 1872. Any disputes shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.

18. Changes to Terms

We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance. We will notify users of significant changes via SMS or in-app notification.
